The Two Child Limit Payment (Scotland) Regulations 2026
I enclose an updated draft copy of the Two Child Limit Payment (Scotland) Regulations 2026, made under sections 79 and 95 of the Social Security (Scotland) Act 2018. This updated version includes changes to regulation 29 (Time of Payment).
As indicated in my initial letter to you, this was required to address the scenario where the dates of an individual’s assessment period are changed by DWP. This can happen when two single Universal Credit recipients form a couple and are transferred to a joint Universal Credit claim as a result. Regulation 29 now includes additional provisions (5) and (6) which allow Ministers to issue a new payment date for Two Child Limit Payment if the recipient has had their assessment period dates changed.
My officials would be happy to discuss these changes further with the Commission if helpful.
