Provisions for inclusion in the Social Security (Up-rating) (Miscellaneous Amendments) (Scotland) Regulations 2026.
Thank you for your letter of 05 December 2025 regarding the draft provisions which will be part of the Social Security (Up-rating) (Miscellaneous Amendments) (Scotland) Regulations 2026 (‘the up-rating regulations’).
I very much appreciate the Commission’s consideration of these amendments in the shortened timescales and your response. I note that the Commission is satisfied that the majority of the draft regulations achieve their aims, and that at the time of writing discussions were ongoing on the Scottish Adult DLA changes. Further to these discussions and the additional complexities raised, I have decided to remove these provisions from the draft Uprating Regulations to allow for greater consideration of changes to Scottish Adult DLA.
Thank you again for considering these miscellaneous amendments in a reduced timeframe alongside your other scrutiny work. I look forward to receiving the Commission’s report on the uprating regulations in full following the budget announcement and referral.
