Provisions for inclusion in the Social Security (Up-rating) (Miscellaneous Amendments) (Scotland) Regulations 2026
Thank you for your letter of 30 October 2025 regarding provisions for inclusion in the Social Security (Up-rating) (Miscellaneous Amendments) (Scotland) Regulations 2026 [hereafter ‘the draft regulations’]. This letter is the Commission’s report on these draft regulations.
We note that the draft regulations have been shared with us in advance of the draft regulations which we expect to be referred to the Commission in due course. This is very useful to our scrutiny as it has allowed us more time to consider the provisions.
On this occasion we are satisfied that the majority of the draft regulations broadly achieve their aims, however, we are still in discussion with officials on the changes to Scottish Adult DLA and will include our final response on these in the draft uprating regulations we expect to receive following the Scottish Government’s budget announcement.
