Funeral Support Payment Amendment Regulations

Following the laying of the above regulations the Delegated Powers and Law Reform Committee highlighted a small error in amendment regulation 2(4)(b), which makes provision for people who would have been entitled to support for funerals abroad prior to the UK’s withdrawal from the EU to continue to receive that support. An incorrect reference had the effect of extending provision beyond the intended policy. I have therefore withdrawn the Funeral Expense Assistance (Scotland) Amendment Regulations 2024 and will lay an amended version of regulations in Parliament on 1 October.

I am attaching a copy of the regulations that will be laid in Parliament on 1 October for information. This amendment does not change the policy intent and these regulations ensure that people who would have been entitled to Funeral Support Payment prior to the UK’s withdrawal from the EU retain that right.
