Draft Carer’s Assistance (Carer Support Payment) (Scotland) Regulations: update for SCoSS
SCoSS received updated draft Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023 from the Scottish Government on 2 June 2023.
Further updates included in these regulations:
- Amendment of Regulation 6(8)(g) to align with changes made recently to wider social security regulations to provide that certain people arriving in Scotland from Sudan would be exempt from having to satisfy the past presence test and habitual residence test. We were considering the requirement for this in light of the planned timing for our Carer Support Payment regulations to come into force, as this is expected to be more than 26 weeks after the 15 April 2023 date before which a person is required to have been residing in Sudan for them to be affected by the amendments. However, as it is possible that a person fleeing Sudan may not come directly to Scotland we will be including this to ensure it will cover all those affected.
- Amendment of Regulation 2 to include definitions of Attendance Allowance and Young Carer Grant.
- Amendment of Regulation 17 to include definitions of the “relevant benefits” for the purpose of abatement provisions.
